Advertiser agreement

This agreement starts when you check the acceptance box, click the acceptance button, or submit a listing or a payment after this text has been shown to you. If you do not agree, do not create an account and do not send content.
We may update this agreement by posting a new version and changing the date above. A later edit does not change the financial obligations for a listing already paid for. The price and the no-refund rule stay as they were at checkout for that purchase. If we change a fee, we email advertisers before the new fee applies to a future purchase.
1. Eligibility and accounts
You may advertise only if you are at least 18, and older if the age of majority where you or the depicted person live is higher, and only if advertising on this site is lawful where you are.
One account per advertiser. You will not sell the account or open another account after a suspension. You are responsible for activity on the account, including activity by a photographer or an agency user you allowed in. Tell us if you believe the account was used without permission. We may refuse, suspend, or close an account that fails the ID check, the publishing rules, or a fraud check.
An agency may submit content only for an adult performer it currently represents, and only after the person who signs has reviewed that performer’s age documents. If the performer leaves the agency, the agency must update or remove the listing within one business day.
2. Age, trafficking, and unlawful content
You will not submit content that depicts a person under 18, that was created before that person was 18, or that suggests anyone in the listing is under 18. Words and styling that present an adult as a child are refused even when an ID shows the person is an adult.
You will not use the site for trafficking, for the exploitation of any person, or to offer or request unlawful activity. We close accounts that do, and we may refer them to law enforcement.
You are responsible for keeping every age and identity record that applies to your content, including 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75 if those laws apply to what you produced, and any equivalent law where the content was made. If we ask, you will give us the custodian’s legal name, the address where the records are kept, and copies of the age records.
Image and text standard. You submit the text and photos in the form you want the public to see. They must show only adults who are at least 18, and they must not suggest that anyone is under 18. You must have the rights to the text and to every photo. Staff may refuse or remove a listing. Staff may compare the face in the listing photos with the ID you uploaded. We do not rewrite your listing. We do not promise that a listing will stay online.
Links. A listing may include a link to your website and links to your social profiles. You are responsible for the pages you link to.
Language. Listing text may be in any language.
3. Identity documents
Before a listing is public you must upload a color photo of a current government photo ID of a type the checker on the site accepts.
If the face is cropped, blurred, or hidden, we may require a clear face photo and we may refuse the ad if the face, the ID, and the listing photos do not match.
ID images and face photos are available only to administrators and are removed after the review is finished, as the privacy policy describes.
4. Your content
You promise that you own the photos and text, or that you have the releases and licenses needed to let us display them, including from every identifiable person. The photos are of the person who is actually offering the advertised services. They are not stock photos and not someone else’s campaign.
You give Dating Pornstar a worldwide, non-exclusive, royalty-free license to host, display, reproduce, crop, and watermark the content with the site brand, on DatingPornstar.com and on pages we use to show the listing. The license to display the content publicly lasts until the listing is closed. After the listing is closed, we may keep copies only for legal and accounting purposes.
Ending this agreement is in section 8. When the listing is closed, public display ends.
We do not promise to police copies of your photos on other sites. You enforce your own copyright against third parties. You may send us a DMCA notice about a copy hosted on this site.
5. Fees
Prices are shown at checkout and on the pricing page, and those figures control. We may change prices for future purchases. If we change a fee, we email advertisers before the new fee applies to a future purchase.
Payment accepted in Bitcoin (BTC). We do not accept card payments and we do not store card numbers. Start the payment from checkout so we can match it to your account. You are responsible for Bitcoin network fees. There are no refunds.
6. Publishing and removal
We may reject or remove a listing that fails this agreement, the ID check, or the law. We do not promise that staff will rewrite your ad. You submit the text and photos in the form you want public, subject to removal. We may suspend or close an account after repeated valid copyright notices.
We are not a party to your services. We are not liable for a person who contacts you from a listing, or for what happens at a meeting. You are an independent contractor. Nothing here makes you our employee, partner, or agent.
7. Privacy of advertiser records
Account data, ID images, payment records, and unpublished photos are handled as described in the privacy policy and this agreement. Payment accepted in Bitcoin (BTC). We do not collect card numbers. We may disclose advertiser information in response to legal process and in the cases listed on the law-enforcement page.
If the business is sold, advertiser personal information may be transferred only as the privacy policy describes.
No website is immune from intrusion. Do not upload an ID if you cannot accept that residual risk. We still apply reasonable safeguards.
8. Termination
Either party may end this agreement for a material breach by giving 10 days’ written notice. Either party may end this agreement without cause on 10 days’ written notice.
When the agreement ends, we remove the listing from public pages. The public-display license ends when the listing is closed. We do not return the files. We may keep copies only for legal and accounting purposes. Fees already paid are not refunded when you cancel, or when we end the agreement for your breach.

9. Indemnity and liability
To the extent Swiss law allows, you will defend and indemnify Dating Pornstar and its staff against a third-party claim that comes from your content, your listing, a meeting arranged from your listing, a false age or identity statement, or a third-party right you did not clear, including reasonable lawyers’ fees on that claim, and including the reasonable cost of responding to legal process caused by your account.
The site and the traffic to your listing are provided as available. We do not warrant a volume of enquiries. Our aggregate liability to you arising out of this agreement in a twelve-month period is limited to the fees you paid us during those twelve months, or CHF 100 if you paid nothing, except where the law does not allow a limit.
Keep your own copies of anything you upload. We are not liable for loss of the content you uploaded.
10. Law and disputes
This agreement is governed by the laws of Switzerland. The courts of Switzerland have jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You had the chance to obtain your own legal advice before accepting. If a clause is held invalid, the rest remains.
Neither party is liable for a delay caused by an event beyond its reasonable control, if it gives the other party prompt notice.
Sections that by their nature should survive the end of this agreement do survive, including unpaid fees, copies kept for legal and accounting purposes, indemnity, age-record duties, and this dispute clause.
